The 15 steps to SAFE-Smart NMLS registration, education, testing and licensure. Abacus Mortgage Training and Education provides this section as a service to the mortgage industry. Please consult you legal advisor for final guidance. To contact the NMLS, click here. 1. What is the SAFE Act? President Bush signed into law the Secure and Fair Enforcement (SAFE) Mortgage Licensing Act on July 30, 2008 as a central part of the Housing and Economic Recovery Act (HERA). Under this act, all mortgage loan officers in the United States must register in a national database, pass a national exam, pass state exams and accrue a minimum of 20 hours of approved education before engaging in mortgage loan origination activities. Existing loan originators must comply with the minimum standards plus any state specific requirements as the states they are licensed in demand. This act sets forth procedures, requirements, education, testing and new standards including mandatory national registration of all Mortgage Loan Originators (MLO’s) plus the state licensing of certain defined MLO’s, through the creation of a Nationwide Mortgage Licensing System and Registry, known as the NMLS. The SAFE Act is regulated by the Department of Housing and Urban Development (HUD). According to HUD's website, the SAFE Act, "... is designed to enhance consumer protection and reduce fraud by encouraging states to establish minimum standards for the licensing and registration of state-licensed mortgage loan originators and for the Conference of State Bank Supervisors (CSBS) and the American Association of Residential Mortgage Regulators (AARMR) to establish and maintain a Nationwide Mortgage Licensing System and Registry (NMLS) for the residential mortgage industry..."To read more, visit HUD's website at: www.hud.gov
LAW: The SAFE Act is the federal law (part of the HERA of 2008) RULES AND REGULATIONS: CSBS and AARMR created the State Regulatory Registry (SRR) to make the rules of how the system would work. ACCOUNTABILITY: Financial Industry Regulatory Agency (FINRA) build the database to keep track of it all. The NMLS is that database and the SRR manages it. SAFE establishes the definition of a Mortgage Loan Originator (MLO) and defines the criteria for who has to be licensed.
This definition pulls in many loan processors. Check your specific state laws for details. For state specific information on licensing, refer to the NMLS State Licensing Resource Page. As states complete the rollout of their legislation and regulation, this map is updated by the SRR. 2b. What if I work for a bank? Employees... "of a depository institution, employees of a subsidiary that is owned and controlled by a depository institution and regulated by a Federal banking agency, or employees of an institution regulated by the Farm Credit Administration" ...are exempt from registering and licensure through the NMLS at this time. That may change in the future. If there is any question about your status, depository vs. non-depository, please consult the legal department of your employer. Back to the top 3. How do I create an NMLS account? For MLOs previously licensed in any state, your introduction to the NMLS will be during what is called transition. When the state you are licensed to do business in begins using the NMLS to manage their MLO data, you will be required to create an account on the NMLS. There is no cost to create an account, however, if you wish to apply to do business in any state, there is a fee for applying. You can usually find your state specfic fees using the NMLS State Licensing Resource Page. Generally, during transition into the NMLS, a state will offer a window where there is no fee to transition. Transitioning outside this window will incur a fee. So pay attention to all the communications your state sends to you! Directions on how to create an NMLS account One of the most important things about creating your NMLS account is getting your "unique identifier." This number will become very important for you as it will be used to track your education hours, exams scores and license status. Every company and branch office will also have their own unique identifying number. All the states, testing companies and education providers will require you to provide them with your unique identifier, which is referred to as your "Individual ID" on the NMLS. In some cases, it will replace your license number with some state agencies. Back to the top 4. Where do you want to do business? In the past, state specific education requirements presented a certain bar of entry into some states. Now that education and examinations are becoming more accessible through centralized adminstration and approval there may be opportunities to originate in states that previously were out of reach. Almost every state has written and passed new licensing legislation in 2009. It is important that you update yourself on the new responsibilities and requirements of each state you want do business in.
Back to the top 5. Does education I have taken in the past count? If you currently hold a license to originate mortgage loans in a state that requires you to take approved prelicensing or continuing education courses, then you may already have completed some, if not all of your 20 hours of nationally required prelicensing education (PE). To find out how much, if any, of your previously taken education can/will count towards your national requirement, please contact the regulator of the state(s) you are currently licensed in. State Regulator Contacts Please Note: Even though you have been previously licensed and you have your full 20 hours of PE, you still MUST take and pass the national licensing exam and go through a new credit and criminal background screening in order to continue originating. Back to the top 6. What is "ACE" and how do I compute my course and exam prep needs? The difficulty is this: Some states are still requiring continuing education this year to renew, just like in previous years. The rub is that this education is "outside" the NMLS system. You have to take your CE, but you also may need to take additional courses in order to satisfy the 20 hours that the NMLS will eventually require from you. Also, some states will require additional SAFE Act, NMLS approved state education either 'in addition to' or 'inside of' that 20 hours. So this gets very complicated. At Abacus we have a team committed to fleshing out this complexity and feeding it into a custom software program that is designed to reccommend what you should purchase and take. The driving force of this engine is to make sure you are covered, but also suggest the smallest combination of time and cost to you. This program is called the Abacus Compliance Engine, or "ACE" for short. NOTICE - August 2009: ACE is on hold at the moment in an 'automated' sense. We ask you to call us in person until September 1. The reasons: 1) Our courses that will fulfill your requirements are pending approval by the NMLS and we will not generate reccommendations for courses until they are approved. 2) The various states are only slowly clarifying their deadlines and requirements. This process will slowly roll out over the coming months. So, we appreciate your patienc and understanding as to why ACE is not 'live' at the moment. Our team, however, is VERY alive. Whichever you choose, you will get the full Abacus experience. Back to the top 7. How do I register with Abacus and obtain my courses and exam study materials? After September 1: You will type a few pieces of information into ACE so we can identify you and communicate by email, you will indicate your target states and hit submit your information. ACE will compute the optimal slate of courses and materials to accomplish your compiance with the least grief and cost. You will review this suggested purchase order and, if all is agreeable, confirm your purchase. The result will be a quick response from our system providing you with all the class information, passwords needed, and your receipt for payment. August 2009: We will accomplish this directly on the phone with you. Please call 888-341-7767. Back to the top 8. What is my 'Student Site Page' and how do I manage my interactions with Abacus? You will have your own individual student information page on AbacusMortgageTraining.com. On this password-protected page you will see the history of your courses taken, certificates issued and upcoming classes. You will be able to change appointments for attendance on this page. Your passwords for the exam cram materials will be accessible. You will also be able to update and edit your other information. When you register with Abacus you will receive a Greeting Email that will direct you to the URL for your Abacus Student Site Page and provide your password. Back to the top 9. How do I make appointments for class? On your Abacus Student Site Page you will see a list of all available dates for the courses in which you are registered. A simple click-and-elect will secure your appointment to attend, either in person or in "live equivelent" format from a remote computer. This process will be simple and straight forward. Back to the top 10. How do I take my classes? You need to embrace the fact that all classes are live classes. We offer two deliver modes: LIve Classroom - The student and the instructor are in the same location. Live Classroom Equivalent - Via a live stream over the internet. The student participates in a live classroom class from a remote location. Whether you choose live or classroom equivalent delivery, you will get the full Abacus experience with exercises, quizzing and the ability to get your individual questions answered. We highly suggest you include SAFE-Smart Exam Cram along with your course registration. The national and state exams are very difficult. The combination of course content and exam preparation is the best game plan for assuring passing the exams. Back to the top 12. I'm ready. How do I take my exams? All of your fees for licensing, renewal and exams have to go through your NMLS account. So even though the NMLS does not give the exams, you do have to pay for them through your NMLS account. Before you begin this process, it is reccommended that you download and read the MLO Testing Handbook. The process is:
13. How do I apply for a license? Initially, whether you have been doing business in the mortgage industry for 20 years or 2 days, you will have to complete an application, called an MU4 form. This is a detailed application and will take you 20-40 minutes to complete. We reccommend having a resume or some other helpful document available while you complete the application as it will require you to input your last ten years employment and residential history. Once you have completed your MU4 and are granted a license, you do not have to complete it again! You will be able to modify/update your information as needed and attest to its accuracy and use the same information for all the states you apply to. First Time Users Start Here Once you are licensed, you can then associate yourself with the broker or lender that you work for so they can notify the NMLS that you are originating for them. It is important that the NMLS know who is originating for what company and where. Back to the top 14. How do I renew my license? In order to renew your license, you must have completed all of your required education in the appropriate topics. Those credit hours are reported to the NMLS by your course provider. Once you are inside your renewal window (November/December) you can log into your NMLS account and complete your renewal. There are, basically, three steps to renewing:
Back to the top 15. So what now? As a condition of renewal, you will be required to take a minimum of eight hours of approved NMLS continuing education each year prior to December 31. Some states will have requirements above and beyond this minimum standard.
